Proposed DUI ordinance for Libby fails

Proposed City Ordinance 1841, the addition of a Chapter 10 to the Libby Municipal Code Title 10, Vehicles and Traffic, failed to pass 3 to 2 at Monday's City Council meeting (Feb. 3, 2014). Councilman Benson was absent. Councilmen Olsen, Desh and Bischoff voted against the ordinance. Peggy Williams and Brent Teske voted to support it.
The proposed ordinance would have provided for a $500 fine, and a misdemeanor, for anyone operating or in physical control of a motor vehicle stopped within the City limits for Driving Under the Influence who refused to submit to take a breath or blood alcohol test following protocol of probable cause and field sobriety tests.
Darby, Missoula and several other Montana cities have adopted similar ordinances, which have survived District and Supreme Court challenges. ________________________________________________
