Troy City attorney fights removal

The battle between Troy Mayor Don Banning and former Troy City attorney Charles Evans continues to rage with Evans filing a Alternative Writ of Prohibition in 19th District Court Friday ordering the City of Troy be prohibited from removing him as the Troy City Attorney, and as an alternative ordering the City to show cause why Evans should not be reinstated.

In court documents obtained by KLCB, Evans claims he was wrongfully discharged from his appointed position without legal right or authority.

Evans was appointed Troy City attorney by Banning April 20, 2011 and sworn into office by unanimous approval of the Troy Council. Evans says a subsequent contract was never presented to the Troy Council for their review or approval.

January 9 this year, Banning sent Evans a letter immediately terminating the contract without notice and no reason for the termination.

At the February 15th Council meeting a motion was made by one of two new Councilmen to terminate Evans, which was seconded by the second new councilmen. Banning called for the vote which was a two-two tie, with Banning breaking the, voting to terminate Evans.
