Libby pit bull ordinance still debated

The prohibition of "pit bulls" within the City of Libby sits at a standoff following the City Council meeting.

Barbara Turner, now claims her dog in question, a dog she has had for years and believed to be a "pit bull", is not a "pit bull".

Turner, armed with the characteristics of a "pit bull" from the kennel club, told the council that her so-called evidence had convinced local veterinarian, Doug Griffith, to change her dogs breed in his records from "pit bull" to an "American Bull Dog".

Part of the problem is the term "pit bull" is vague and generic in nature. Wikipedia lists some 15 dogs commonly referred to as "pit bulls". The "American Bull Dog" is part of that list. The term is used to define any breeds raised as "pit" fighters in dog fighting rings.

Turners time limit to remove her pit bull from the city expires September 20th.

Turner originally had two dogs, she herself referred to as "pit bulls". The younger one recently died suddenly of a fast moving cancer, according to Turner, leaving her with the remaining dog, which she now says is not a "pit bull".

City Attorney Chuck Evans said the discussion is moot, if the Council accepts Doctor Griffith's opinion that the dog is not a "pit bull". The City wants that in writing from Griffith. No citation has been issued at this point. Turner has simply been warned to remove the dog.

Evans repeated the Council has no part of enforcement of the ordinance. As a body it can create, modify, and rescind the ordinance but not enforce it. Evans said until a citation is issued and the issue ends up in court, Turner's dog is just like any other legal dog within the City.

Until then, because Evans, said mostly likely animal control will issue a citation on September 20th, which will put the issue in court, where Evans says it belongs.

Violation of the "pit bull" ordinance is a misdemeanor and carries a fine of up to $500 on first offense, and up to six months in jail and the fine for a repeat offense.
