Stu Crismore files legal action
Asks to be reinstated to City Council

Former City Councilman, Stu Crismore, has filed legal action against the Libby City Council, City of Libby and City Attorney Charles Evans. In papers filed in 19th District Court Crismore asks to be reinstated to his seat on the Libby City Council and to recover legal fees incurred.

On August 6th City council members voted 3 to 3 to remove Crismore for neglect of his duty. Mayor Tony Berget cast a tie-breaking vote to make the vote 4-3 in favor of removing Crismore.

Neglect of his duty in this case centered around Crismore's failure to attend regularly scheduled meetings and budget meetings.

Crismore maintains that his absence from meetings was because of work obligations. Crismore does not feel that he at any time neglected his duty as Libby City Council person.

Crismore's petition in District Court charges that the Libby City Council removed him arbitrarily without notice, without cause, and without the two-thirds vote required by Montana law.
