Crismore voted off Libby City Council

Councilman Stu Crismore has been voted off the Libby city council. Members of the council felt Crismore had neglected his office because of his failure to attend City Council meetings over the last two months.
Crismore cited work obligations as the reason for his absence from budget meetings and regularly scheduled City Council meetings.
With a tied vote of 3 - 3, Mayor Tony Berget cast the deciding yes vote in favor of removing Crismore from the Council. It is common practice for the Mayor to break tie votes. Crismore is arguing, however, that the Montana Code Annotated 7-5-4103 requires a two-thirds majory vote which would require a vote of 4-2 to expel a council member. With the Mayor's tie breaker the vote was 4-3, which would be 58%.
The question becomes, was the Council's vote to oust Crismore legal?
