Missoula Judge Dismisses Lawsuit against ASARCO
CRG Claim Set Aside

A federal judge in Missoula has dismissed a suit filed by an environmental group against operators of the Troy Mine.
Earlier this month U.S. District Court Judge Donald W. Molloy dismissed without prejudice the case brought by the Cabinet Resource Group (CRG), which claimed in a 2002 lawsuit that the previous operators of the mine had illegally buried barrels containing toxins in the mine’s tailings facility. The lawsuit was aimed at ASARCO, Inc., which operated the Troy mine from 1981 to 1993. In 2004 the underground copper-silver mine was re-opened by a subsidiary of Revett Silver.
“We’re pleased Judge Molloy has dismissed the lawsuit,” said Revett President and CEO Bill Orchow. “Opponents of the mine have long used this myth to try to discredit the mine and the excellent people who work at Troy. We take all regulations very seriously and are dedicated to running a clean operation. Water monitoring data gathered over a twenty plus year period shows no impact to either surface or ground water.”
The Troy Mine is operated by Genesis, Inc., a subsidiary of Revett Silver. It is located 15 miles southwest of Troy in Lincoln County with employment of 150 workers, an annual payroll of approximately $10 million and economic impact exceeding $20 million, according to Revett Silver Company.
