DOJ seeks asbestos victims
April 4, 2005
The US Department of Justice-District of Montana (DOJ), is asking anyone who feels they are a victim of the asbestos exposure from the Libby W.R. Grace vermiculite mine to complete a Request for Notification of Case Events form.
Filling out this form is important for two reasons. As a victim, people have the right to be kept informed on the status of the investigation and court proceedings at all times. The form also gives the U.S. Attorney’s office a way to quantify victims and impacts, which is helpful if the defendants are found guilty and ordered to pay restitution.
Some people have already been identified and have received a notification letter in the mail from the DOJ. Once on the list, victims will be given a personal Victim Identification Number and a Personal Identification Number. With those numbers, victims can find out more information about the status of the case. There is a 1-800 number to call, and online information available using the ID numbers, for the most current information on the case status.
According to the victim notification letter, "Charges have been filed against defendant(s), WR Grace, Alan Stringer, Robert Bettacchi, Robert Walsh, O. Mario Favorito, William McCaig, Jack Wolter, Henry Eschenbach, by Indictment. The main charge is categorized as Environmental Crime. The lead prosecutor for this case is Assistant U.S. Attorney, Kris A. McLean."
Trial dates have been scheduled for May 15, 2006, 08:45 am, at Missoula and for September 11, 2006 at 8:45 am in Missoula. These date may change. Charges were filed on February 7, 2005.
